TERMS OF PURCHASE

The parties

The seller is Sögne Home AS, Birkedalsveien 26, 4640 Søgne, post@sognehome.no, +47 90 07 23 90, 997 182 685, and is hereinafter referred to as “seller/the seller”.

The buyer is the consumer who places the order and is hereinafter referred to as “buyer/the buyer”.

Payment and return:

These terms of purchase apply to all sales of goods from the online store to consumers and to online store sales. The customer’s order confirmation/order, together with these conditions, constitutes the overall contractual basis for the transaction. These conditions apply only to sales in Norway, including Svalbard and Jan Mayen. Any shipping costs to the latter must be taken over the phone following order registration. Customers outside this area must contact us by letter, e-mail or phone. Sales to consumers are regulated among other things in the Consumer Purchases Act (forbrukerkjøpsloven) and the Act Relating to a Cooling-off Period in Connection with Certain Contracts for Consumer Purchases (angrerettsloven). We are responsible for transactions by payment cards through the website. 

The seller may require payment for the product at the time it is sent from the seller to the buyer.

If the buyer uses a credit or debit card for payment, the seller can reserve the purchase sum on the card when ordering. The card will be charged the same day the product is sent.

When paying by invoice (only applies to dealers), the invoice to the buyer will be issued when the product is dispatched. The payment deadline is shown on the invoice and is a minimum of 14 days from receipt.

Delivery

Delivery has taken place when the buyer or their representative has taken possession of the item.

If the delivery time does not appear on the order solution, the seller must deliver the product to the buyer without undue delay and no later than 30 days after the order from the customer. The product must be delivered to the buyer unless otherwise agreed between the parties. Prices
The prices include 25% VAT.
If VAT, taxes or other fees are changed, our prices will change accordingly.

Ordering:
All orders are considered binding. You will receive an order confirmation by e-mail with all the information. In addition, you will receive an e-mail with information as the order is processed by us.

When purchasing through DIBS payment module:

The conditions of sale, together with your order, confirmed by way of an order confirmation, constitute the entire contractual basis for the purchase. Shop.sognehome.no is responsible for transactions through the website.

We use 3D Secure on our sites and all transactions go through secure sites

3D Secure – even more secure payment over the Internet

3D Secure is a common security standard for payment over the Internet with VISA (Verified by Visa) and MasterCard (SecureCode).

What is 3D Secure:

3D Secure (Verified by VISA and MasterCard SecureCode) is the security solution that VISA and MasterCard use to identify cardholders when making online purchases. 3D Secure has become a requirement from card acquirers for making online transaction even more secure.

How to pay with 3D Secure:

If your card issuer uses 3D Secure as an extra security check during payment, you will encounter a separate page where you enter a code from the online banking calculator or password (BankID). This communication goes between you and the bank, and we cannot see the password or the code you enter.

For your security we will not store the number of your payment card.

Cancellation/refund:

Provided that the order is not being processed (the dispatch has been packed and/or sent), you can access “your page” to cancel the order. This applies only if you have created an account in the store. For customers who have used the express checkout, please contact us through our contact form.

If you exercise your right of cancellation and have paid for dispatch in advance (e.g. by VISA/MasterCard), we will refund the amount paid within 14 days.

Other terms of sale:

Export restrictions in accordance with OFAC, EU and UN regulations. We do not sell products to Burma, the Ivory Coast, Iraq, Iran, Congo, Cuba, Liberia, North Korea, Zimbabwe, Sudan, Syria, or Belarus.

You cancellation and return rights
cancellation right:

After you have received the products, you must check as soon as you are able and within a reasonable time whether the delivery is in accordance with the order confirmation, whether the products have been damaged during transport and whether the products are otherwise defective or deficient. Contact us if anything is wrong and we will help you.

No transaction is complete until you have seen and approved the product. If you regret making a purchase, you should notify this by e-mail or return the product in complete packaging within 14 days of receipt (the cooling-off period) and enclose a documented explanation of your reason for returning the product. You decide whether you would like another product or your money back. Please note that the cooling-off period will be extended to three months if the document explaining the return does not accompany the product. The condition for return is that the product not be used and that it can be sold as new. All labels must be attached and the original packaging must also be included. You can return a product without stating a reason for this, but it is requested that you describe the reason for return on the return form.

If you exercise your right of cancellation and return the product(s) as a postal package or letter, you will cover the return costs. You are responsible for the transport risk. Complete the document explaining the return and state what you are returning. Once the product(s) has been returned to us undamaged, we will refund the amount you have paid within 30 days. State your bank or postal giro account number on the return form, and the money will be refunded to your account quickly; otherwise the money will be sent to a regular payment card.

Please note that merchandise cannot be replaced or returned.

Cancellation right:

Unless the agreement is exempt from the cancellation right, the buyer can cancel the purchase of the product in accordance with the Act Relating to a Cooling-off Period in Connection with Certain Contracts for Consumer Purchases.

The buyer must notify the seller if they exercise the cancellation right within 14 days of the cooling-off period. The cooling-off period includes all calendar days. If the period ends on a Saturday, public holiday or festival day, the cooling-off period will be extended to the next working day. The cancellation right of 14 days also applies to merchandise.

The cooling-off period is considered to be complied with if notification is sent before the expiry of the cooling-off period. The buyer has the burden of proof for proving that the cancellation right has been exercised, and notification should therefore take place in writing (cancellation right form, e-mail or letter).

The cooling-off period starts:

  • When purchasing individual products the cooling-off period will start the day after the product(s) has been received.
  • When selling subscriptions, or if the agreement involves regular delivery of identical products, the period will run from the date after the first dispatch has been received.
  • If the purchase consists of several deliveries, the cooling-off period will run from the date after the last delivery has been received.

The cooling-off period will be extended to 12 months after the expiry of the original period if the seller does not notify before concluding the agreement that there is a cancellation right and a standardised cancellation form. The same applies in the event of a lack of information on conditions, cooling-off periods and procedures for exercising the cancellation right. If the trader makes sure to provide information during these 12 months, the cooling-off period will still expire 14 days after the date the buyer receives the information.

When exercising the cancellation right, the product must be returned to the seller without undue delay and no later than 14 days from when notification of the exercising of the cancellation right has been given. The buyer covers the direct costs of returning the product, unless otherwise agreed or the seller has failed to state that the buyer must cover the costs of returning. The seller cannot set fees for a buyer exercising the cancellation right.

The buyer can try or test the product in a reasonable manner in order to ascertain the nature, properties and function of the product without the cancellation right lapsing. If trying or testing the product takes place in a manner that goes beyond what is reasonable and necessary, the buyer may be responsible for any reduction in the value of the product.

The seller is obligated to refund the purchase sum to the buyer without undue delay, and no later than 14 days from when the seller was notified of the buyer’s decision to exercise the cancellation right. The seller has the right to withhold payment until they have received the products from the buyer, or until the buyer has attached documentation explaining why the products have been returned. Force majeure: Should a situation arise that makes it impossible for us to fulfil our obligations according to this agreement and which, according to normal sale of goods rules, is considered to be force majeure, the affected party’s obligations will cease for as long as the extraordinary situation persists. Examples of force majeure include changes in the law, industrial disputes, strikes, lockouts or other circumstances over which the parties have no control such as war, unrest, fire, explosions or intervention by public authorities. The same applies in the event of sudden changes to requirements on labelling products, warning texts, sales bans or decisions by the authorities that affect the market and products adversely, or an abnormal downturn in the market. Minimum age:  To shop in our online store, you must be 18 years of age or older. If you are under 18 years of age, you can get an adult such as a parent or guardian to shop for you.
Information provided in the online store

Product defect – the buyer’s rights and the complaint deadline

If a product is defective, the buyer must, in a reasonable time after this is discovered or should have been discovered, notify the seller that they will invoke the defect. The buyer will always have complained in time if this takes place within two months of when the defect was or should have been discovered. The complaint can be made no later than two years after the buyer receives the product. If the product or parts of it are intended to last significantly longer than two years, the complaint deadline is five years.

If the product has a defect and this is not due to the buyer or conditions on the part of the buyer, the buyer can, in accordance with the rules of Chapter 6 of the Consumer Purchase Act, according to the circumstances, withhold the purchase price, choose between correction and re-delivery, demand a price reduction, demand the agreement be terminated and/or demand compensation from the seller.

Complaints to the seller should be made in writing.

Correction or re-delivery
The buyer can choose between demanding that the defect be corrected or delivery of an equivalent product. The seller may nevertheless oppose the buyer’s claim if implementing the demand is impossible or results in the seller incurring unreasonable costs. Correction or re-delivery must take place within a reasonable time. The seller is not in principle entitled to make more than two attempts to rectify the same defect.

Price reduction
The buyer may demand an appropriate price reduction if the product is not corrected or re-delivered. This means that the relationship between the reduced and agreed price corresponds to the relationship between the value of the product in defective and contractual condition. If there are special grounds, the price reduction may instead equate to an amount corresponding to the significance of the defect according to the buyer.

Cancellation
If the product is not corrected or re-delivered, the buyer can also cancel the purchase when the defect is not insignificant.

We strive to provide our customers with information about our products that is as correct as possible. However, we reserve the right to make typing/printing errors, which may mean that we cannot deliver in accordance with the information provided in our online store or our marketing or in any other way.

Complaints are directed to the seller within a reasonable time. The parties must try to resolve any disputes amicably. If this is unsuccessful, the buyer can contact the Consumer Council for mediation. The Consumer Council can be contacted by phone on +47 23  400  500  or at www.forbrukerradet.no.
